    iBayDirect LLC (“we,” “us,” “our,” or “iBaydirect”) is committed to demonstrating the highest level of integrity in dealing with its customers. By using our website, services, purchasing or requesting information on our products and services or by providing us personal information, you agree to the policies, practices, and terms herein contained. We routinely update our policy and therefore invite you to consult it again from time to time to ensure you are aware of any changes. When we make major changes, you will be informed by email (if you provided us with an email address). For minor changes, the latest changes will be highlighted in yellow.

Note that should alternatives not be offered to you on web pages where your personal information is requested and obtained, you may provide us your communication preferences through one of the communication channels detailed at the bottom of this statement.
  1. What information we gather and track
    iBay Direct collects personal information which it deems to be reasonably necessary to provide our services to you, e.g. to pursue our contractual obligations and serve a legitimate business purpose. We request personal information when you place an order, create an Account, register a product, request a service, answer a survey, enter a contest, do a training, correspond with us or engage in certain other activities on our website. If you request technical support online, you will be asked to provide the information necessary to complete the transaction. At any time, you will have the option to decide not to proceed with the transaction requiring your personal information.

Account creation and contact information (for example an email address). In order to activate and/or use some of our products or services, you will need to create a iBay Direct (“Account”). During the process of setting up your account, we will ask you for certain PII such as your email address. We need this information to allow you to activate, manage or use your products and services. We may associate your email address and other PII (such as name, telephone number, and address) with your Account. You might also provide us with your contact information through other interactions with us, whether through the use of our services, a form on our website, an interaction with our sales or customer support team, or a response to one of our surveys (operated by SurveyMonkey).

Usage information. We collect usage information about you whenever you interact with our websites, services, and products either directly or through third-party service providers (e.g. Google Analytics, Pardot, and Matomo). This includes which web pages you visit, features you use in our products, what you click on, when you perform those actions, what language preference you have, and so on. Log Data. Like most websites today, our web servers and service provider (WP Engine) keep log files that record data each time a device accesses those servers.     1. Consequences if we may not collect your PII
      We need your PII to provide our services to you. Without providing such PII we may not be able to provide you the services you are intending to receive.
    1. The legal basis of collecting, processing and using your PII
      Our services are subject to the laws applicable in the countries where we provide our services. We collect, process and use your PII in accordance with the applicable laws of all relevant countries. Our services in the EU are subject to the GDPR and under the GDPR we collect, process and use your PII for the purposes listed above according to Art. 6 para. 1a, 1b, and 1f GDPR.
    1. Choice/double-opt-in/opt-out
      When you create an Account, you will be invited to confirm your email address and intention to receive our e-mails, newsletter, and bulletins. If, after opting-in, you do not wish to continue receiving our e-mail newsletters or bulletins, you can opt-out of receiving these communications by replying “unsubscribe” in the subject line in the email or by changing your preferences within your Account. If you are an active customer using one of our products or services, note that we may still communicate with you regarding such products and services.
    1. Security Measures and Protection of PII
      We have put in place lawful and industry-standard safeguards to protect your PII. For example, some information transmitted to 2020 will be in encrypted form using the Secure Socket Layer (SSL) certificate. We do this to make sure that your PII is not lost, harmed, lost or deleted.
      Anyone at 2020 who has access to PII has been informed about the proper and lawful way such data should be handled.

      You can visit most areas of 2020’s web site without disclosing any personal information. 2020 only logs the domain name, IP address and browser type of our website visitors via our web server log files and analytics tools at irregular intervals.     1. When we erase your PII
      We erase your PII automatically when they are no longer required for the purposes listed above. We further erase your PII according to your request and if further storage is neither required nor permitted by applicable laws.
    2. Your rights related to data privacy
      You have the right to request access to and rectification or erasure of your PII, or restriction of their processing. Furthermore, you have the right to object processing as well as to request data portability. If you are in the EU you have the right to file a complaint with the responsible European data privacy authority.
